Hit By Train at Dangerous, Unguarded Rail Crossing, Trucker Gets Ticket
(Wilmington, Delaware – June 27, 2011)
The driver of a tractor-trailer semi truck had insult added to injury Monday afternoon at 1:35 P.M. when his Freightliner tractor hauling an empty box trailer was struck and heavily damaged by a Norfolk Southern freight train at the dangerous, unguarded Railroad crossing of Pigeon Point Road in Wilmington, Delaware.
Driver Selven D. Ellena was cited by Delaware State Police for “inattentive driving” even though the crossing was marked only with passive railroad crossbuck signs and had no electronic warning of approaching trains. Railroad officials and Operation Lifesaver “Grade Crossing Collision Investigation Courses” encourage law enforcement officers to always assume the highway user is at fault and to issue a citation in the case of any crossing collision.
