Minnesota Supreme Court Says BNSF Not Entitled to New Trial: A Win for Pottroff & Karlin, LLC

The Minnesota Supreme Court handed down an opinion Wednesday morning that reinstated a jury virdict of $6 million in wrongful death damages for each of the four passengers who were hit by a BNSF train back in 2003.  The Court determined that BNSF was not entitled to a new trial and upheld jury instructions that punished BNSF for negligently spoliating evidence.
