States have varying laws regarding automobile accidents. However, most states fall into two main categories, no fault and at-fault.

• No Fault states design their laws so that each person involved in an accident is responsible for his or her own loss.  Approximately 50% of states employ such laws.
• Fault does come into play in some of these states under certain circumstances such as severe injury, in which a jury may attribute fault to one party.  A driver may also be at fault because s/he has broken the law, i.e., drunk driving. In at-fault states, the driver responsible for causing the accident is also liable for damages to the other party.  It is much easier for a jury to assign fault in these states.

The rules of fault apply to the wide range of auto accidents, including fatal car accidents, cars hit at railroad grade crossings, etc. Fault laws are crucial because they determine who pays for the medical bills, lost wages, pain and suffering, etc. that results from accidents.
